I am glad to see this, and I fully expect the state to prevail against the NCAA. The NCAA grossly overstepped it's authority, and it's time for the smack-down to take place.
I do regret the backdrop of this litigation, and the awfulness of Sandusky's acts cannot be cast as anything other than they were. But really horrible situations often provoke people to do something, even if it's wrong. It's time for cooler heads to examine this in a fresh light, and to set some boundaries that the NCAA should be well aware they exceeded.
The NCAA is hoping that public anger will insulate them from the needed correction, but I suspect that will not be enough.
