Sources close to Eric Bledsoe's camp tell me he is planning a lawsuit against whoever released his transcripts to the New York Times Interesting

If this proves true, things are only beginning to get interesting.  The parties in a civil suit will be able to issue subpoenas.

As James A. Wells, Assistant U.S. Attorney General remarked in Absence of Malice:  "Wonderful thing, a subpoena."  The plot thickens ...

I hope he does and wins the biggest game of his life… NYT can and will impune anyone and it is up to the individual to prove their innocence.. I just think it is wonderful the NYT is so corrupt that they were completely busted a couple of years ago and the mexican cell phone magnate from Mexico City had to bail their ass out…. just like CBS when the french company Viacom bailed their ass out… who bailed the HL out… when I lived in Lex they weren’t worth 2 dead flies and, based on Clay’s comments, I’d say they haven’t changed… They use facts to suit their purpose.. There seems to be something about the media, they can say as they want, and chalk it up to an “anonymous source”…

In a case like this, it would be extraordinary. Even in federal criminal cases, it is very difficult.

I would bet big money against.

the “sources” will not be divulged…but i’m also leaning to an anti-trust suit against NCAA, and impingement of Eric’s civil rights on both NCAA and NYT…hope Eric’s attorney is looking for blood in this one!!!

If nothing else, his school records are confidential and shouldn’t be released without his permission. Isn’t releasing someone’s confidential records without their consent against the law?

I hope whoever did release his records is punished, but I’m not naive enough to believe that it’s going to happen.

And this changes the circumstances around the $1200 and hyper-inflated GPA, how?

Seems to me that Eric would be better served on hiring a lawyer to defend him from the accusations….that is to say if there IS anything to defend.

I just don’t think this potential move is helpful to Eric or UK. In fact it may reveal something.

Oh, boy.

Just once I’d like to see someone hold ‘the kid’ responsible and question him and his actions…instead of the NYT, the NCAA, Pat Forde, the C-J, Jerry Tipton, society, health care reform, the designator-hitter rule, or man’s inhumanity against man.

The ‘everybody is against us defense’ and the ‘rules suck defense’ is not helpful and is sure as heck not protective of UK as an educational institute.

At this point ...

… there is no reason to question the kid or his actions. There is no intimation by the Times that Bledsoe knew about any of this.

It is not impossible, of course, that he did know. But the Times report is very careful about that point, and does not point fingers at Bledsoe himself, but at his high school coach and parent.

In fact, the Times specifically states that Bledsoe himself has a good reputation and was well liked. That doesn’t make him innocent, of course, but at the moment, only the adults appear to be potentially blameworthy.

but I’m not sure that Eric Bledsoe has much to defend, even IF his GPA was inflated and the coach payed the $1200. Seems like those are decisions the people around him made (I’m not saying he was ignorant of them). Fact is, he was a minor.

But, I do agree with you that this doesn’t change the GPA and the $1200. It just seems like his rights were violated, and he should stand up for himself in that matter.

arguable point, but it raises an interesting question...

who is going to pay for his legal fight?

i’m pretty sure his family can’t afford it given the background that has framed the allegations to this point. i doubt the university is raring for such a battle with the NYT and i really doubt they’d let bledsoe speak publically about it if they were. if he goes it alone then wouldn’t anyone providing money or services for his case be liable to NCAA regulations concerning impermissible benefits?

bottom line… i’m having a hard time putting much stock in this. it sounds like one of his family was talking about getting a lawyer to sue and the news outlet phrased it in such a way to make it sound like a scoop.

Let's see,

there is a pretty good chance that Bledsoe is coming into some money soon. Also, lawyers who think they have a pretty good case are prone to make a deal for a percentage of the award.

but that is a VERY thin line to walk in terms of compliance...

a lawyer waiving fees in lieu of a client’s expected largesse is extremely close to an agent signing a player for a cut of his pay. and any university with a serious concern about an ncaa investigation is likely to be very clear with the student athlete about the situation.

that said, if bledsoe seriously believes he has a case, there would seem to be nothing preventing him from taking action after he ends his career at kentucky. but the downside there is having an unpleasant legal battle with the preeminent newspaper in the country is likely to cut into his bottom line in terms of his personal saleability.

i’m not saying it can’t happen. i’m not saying it won’t happen. but i am saying it seems highly unlikely.

Bledsoe has already seperated from UK. The NCAA closed the Randolp Morris loophole, so once he didn’t pull his name from the draft by the deadline he lost any remaining eligibility.

i am neither an expert on the situation or the legal issues at play. i’m just offering an observation as a (quasi) objective observer. i guess my expertise here is as a fan of a school absolutely paranoid about compliance issues.

[and my interest in this whole drama as an alabama fan is in terms of the inquiries about the HS coach whom we’ve had issues with in the past.]

It would not be a lawyer waiving fees.

It would be a lawyer acting on contingency, typically with the lawyer taking 25%-40% of any damanges in the event Bledsoe recovered them.

With the exception of child custody cases, contingency arrangements are fully within the rules of professional conduct for attorneys.

Even the GPA, doesn’t change anything. But if someone committed a crime in obtaining his transcript without his consent, then he has a case.

Maybe he is making the move

because there is nothing to be worried about revealing. I say good for him! If his transcripts werent to be released, that is breaking a rule. Everyone is all hyped up at Bledsoe and UK for allegedly breaking a rule, why should whoever leaked those transcripts get a pass?

It is not worth an intelligent man’s time to be in the majority. By definition, there are already enough people to do that.

Transcripts are private records and someone violated a law by leaking them.

Bledsoe's allegation will bed that someone released his records.

The truth of the story is really irrelevent to the lawsuit. Bledsoe’s lawyers will likely move to limit discovery based on the issues.

He quickly became one of my favorite Wildcats of all time. He gets a bad rap for having a “bad attitude.” He is goofy, and some writers take that as being aloof.

Just remember this. When he was given the ball down low, there was no one in college basketball that could stop him. Period.

Clay Travis is a talk radio host and not a practing attorney for a reason.

The NYT would not be able to do depositions as they would probably not be a party. His lawsuit is against the person who gave the NYT his grades. Furthermore, even if the NYT became a party, whether or not Bledsoe’s grade was inflated is irrelevant as the issue is who gave the NYT his info.

Basically, someone at the school or with the NCAA (if someone there leaked his grades) would be in hot water.

Story just ahead of the NBA draft!

The fact that the story broke out just before the NBA draft may cause Bledsoe to lose millions if his draft position changes from the expected position. I think he has solid grounds to really sue for some big bucks.

Since the NYT used documents obtained illegaly, then they would be jointly and severally liable in the lawsuit.

All the article did was make accusations. No offer

of proof was made. No record, affadavit, no one going on record. Just a lot of speculation. Makes one proud not to be a reporter. Or from New York.

I don't think the lawsuit would be over the facts.

It would more likely be over the illegally-released transcript. The rest of the facts are largely irrelevant to that.

it seems the heart of the NYT article is the investigation, not the accusations about bledsoe’s past themselves.

given what other media outlets have said, the rumors around bledsoe’s recruitment have been around for some time. the main difference in the NYT article is they have a source (anonymous, of course) they believe solid enough to indicate there is an NCAA investigation. this is what their rather formidable credibility is hanging on, not if the rumors themselves prove to be true or not.

Just curious

Has the NYT weighed in on the mess at UConn basketball? I know that the Bledsoe issue was in the making for some time, and that it didn’t have anything to do with deflecting chatter about the Huskies, but I wonder it the NYT made any kind of early replies about the UConn situation.

I'm busy - can anyone tell what the status of the mess at UConn is?

I vaguely recall hearing that everyone at UConn was cleared in something around the time of March Madness. Is that not correct?

Basically (and I'm paraphrasing)

This all stems from the recruitment of Nate Miles. As I understand it, the crux of the allegations are a bunch of impermissible phone calls to Miles and his associates from the UConn coaching staff (think Kelvin Sampson-lite).

Miles ended up signing with the Huskies, but never suited up for them after violating a restraining order taken out by his (ex?-) girlfriend and getting kicked out of school.

As for punishments, the two assistants most heavily involved were made to fall on their swords, Calhoun was cited for failure to properly supervise (though this did not prevent him from signing a lucrative extension and being hailed as a fine leader of men), and I don’t believe program sanctions have yet been meted out (but could be wrong). I think all assume that program sanctions will be fairly mild (perhaps probation plus a loss of a scholarship or so), but they won’t have to forfeit any games as Miles never played.

That’s the high level summary, anyway.

We don't know what the penalties will be.

The NCAA won’t issue its report until December, it seems.

I guess I had heard about the falling on the swords part, but I did not realize Calhoun got a failure to supervise finding. I guess it is worth pointing out that Cal does not even have a failure to supervise rap sheet – since neither he nor his assistants have been cited for wrongdoing I guess.

NYT, not dummies.

Just an observation here about NYT and newspapers in general. All of the large news
outlets like NYT have a battery of lawyers. These guys are intelligent, smart, and well
versed in corporate law defense. Besides the NYT will not be the defendent.

of course, he pronounced it “suh-peeny”…classic…how is it that UK “paid” EB’s high-school coach to “direct” EB to UK, when his high-school coach didn’t want him going to UK in the first place…I hope EB sues whomever leaked his transcript…and is it possible to turn around an academic career ? yes…my first semester in college I was at a 1.79 and put on academic probation…met a girl (and thus didn’t want to get kicked out of school) and raised my GPA the next semester to a 3.6…I just started going to class more and actually paying attention…this whole thing seems fishy to me…headhunting? quite possibly…sad though that this was the prevalent story ahead of the Kansas and UConn issues…that should prove what the national media has in form of an agenda (and some local Kentucky writers as well) …Pitino Jr, could be looking for work shortly…and a good attorney

Love Wilford Brimley. One of my favorite character actors of all time.

I suspect Bledsoe, if he sues anyone, will sue the individual(s) and/or organizations who illegally leaked his private information. He would have no real cause of action against the the Times, and I suspect he would be ruled at least a limited public figure, which puts the bar for a defamation case very high. Plus, I can’t really see how the Times defamed Bledsoe.

I’m sure the lawyers around here could lay it out better.
